1. Terms of Use
B Catalysts, operating under the name of Intuitive Science & Math, publishes concept-based study material in science and mathematics (explanations, questions and worked solutions organised by exam, subject and chapter) and intends to extend this material to further subjects and levels over time.
These Terms and Conditions of Use (hereinafter Terms of Use) pertain to the material and services made available at https://ecatalysts.in and to any associated pages and services managed by us, referred to collectively as the Website. We request that you read the Terms of Use thoroughly before using the Website, as they govern your use of it.
For the purpose of these Terms of Use, wherever the context so requires, You, Your, Yourself or User shall mean any natural or legal person who browses the Website, whether or not signed in to an Account. The terms We, Us and Our shall mean B Catalysts.
We reserve the right to amend these Terms of Use at any time, and any amendment will be published on this page. Please ensure that you read these Terms of Use, and any updated version of them, before continuing to use the Website. These Terms of Use are subject to amendment without prior notice and it is your responsibility to remain apprised of the same.
These Terms of Use apply solely to our Website. The terms of other websites, including any site reached through a link or an advertisement shown here, may differ, and we are not responsible for them.
2. Acceptance of Terms
- These Terms of Use set forth a legally binding contract between us and you, and by using the Website you agree to the Terms of Use stated herein. They apply equally if you only visit the Website or review any of the material made available by us. If you do not agree to these Terms of Use, please do not access or use the Website.
- This document is an electronic record in terms of the Information Technology Act, 2000 (IT Act) as amended, and the Rules applicable thereunder, and the provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signature.
- We reserve the right to review, update and replace the content and features of the Website, including explanations, questions, solutions and the way they are organised, at any time, in order to reflect current syllabuses, evidence and practice. We do not guarantee that any particular content or feature available today will remain available in future.
- We are not responsible or liable for any consequence arising from misuse of the Website by you, including any harm or injury caused to a third party.
- Due to the global nature of the internet, you agree to comply with all applicable local, state and national laws and regulations regarding your use of the Website, including all applicable laws regarding the transmission of technical data and information exported from India or from the country in which you reside.
3. Eligibility
- Persons who are competent to contract within the meaning of the Indian Contract Act, 1872 are eligible to use the Website. If you are a minor and wish to use the Website, such use shall be made available to you by your legal guardian or parent, who has agreed to these Terms of Use. In the event a minor uses the Website, it is assumed that the consent of the legal guardian or parent has been obtained.
- The Website is free to browse. Most of the material published on it, including the solutions to many questions, can be read without registration or sign-in. The solutions to some questions are Member Content, which can be read only after you create a free Account and sign in, as described in the Member Accounts section.
- At present, no payment is required for any part of the Website, including an Account, and we do not ask for payment details in order to access the material. We reserve the right to introduce paid features, subscriptions or plans in future. Any such offering will be subject to additional terms published at that time, and will not apply to you unless you choose to take it up.
- Access to the administration area of the Website is restricted to authorised personnel. Any attempt by any other person to access it is a breach of these Terms of Use.
4. The Service We Provide
- In these Terms of Use, Study Material means the explanations, questions, answer options, worked solutions, notes, images and any other learning material published on the Website from time to time.
- Member Content means the solutions, and any answer options, hints and images held back with them, of those questions that are marked on the Website as requiring sign-in. Member Content forms part of the Study Material. An Account means a free member account registered on the Website.
- We decide at our discretion which questions have solutions that are available to everyone and which are Member Content, and we may change this for any question at any time.
- The Study Material is provided for personal, non-commercial study and for knowledge enhancement only. It is not a substitute for your own study, for your school or college course, or for professional advice of any kind.
- The Website is supported by advertising. Advertisements are how we fund the free availability of the Study Material.
- Signed-in members may search the Study Material by entering text and, where image search is enabled for their Account, by pasting an image. We decide which Accounts have image search, and it may in future be offered only as a paid feature. Neither the text entered for a search nor any pasted image is stored by the Website. A pasted image is read in your browser, on your own Device, and is never uploaded to us or sent to any third party. The search text, including any text read from an image, is used only to return the matching results at that moment and is then discarded. It is not saved to our database, your Account, your session, any file or any log, and is not used for any other purpose. Further details are in the Privacy Policy.
- You must paste only images that you are entitled to use. Search results are matched automatically, text recognition can make mistakes, and we do not guarantee that a search will find a particular problem or that its results will be complete or accurate.
- With your consent, the Website remembers the last content page you visited and offers a link back to it from the home page. This feature is optional and is provided for convenience only; we do not guarantee that it will always be available or accurate, for example where the page has since been moved or removed.
- You agree that the scope of the Website and the material on it may change at our discretion, and that we may add, remove or modify content and features at any time.
- We reserve the right to restrict, suspend or terminate your access to the whole or any part of the Website, with or without prior notice and without any liability to you.
5. Member Accounts
- Creating an Account is free and optional. It is needed only to read Member Content.
- You must review and accept these Terms of Use and our Privacy Policy when you create an Account. We record the date and time of each acceptance. An Account cannot be used until both have been accepted.
- Where we create an Account on your behalf, we email you a single-use sign-up link. The Account can be used only after you open the link, review and accept these Terms of Use and the Privacy Policy, and choose your own password. The link expires after a limited time. You may ask us for a new one.
- When you create an Account you agree to give your real name and an email address that belongs to you and that you can access, and to keep them up to date.
- Your Account is for your personal use only. You must not share your password or your Account with anyone else, or let anyone else sign in to it. You are responsible for all activity that takes place under your Account.
- You must keep your password confidential, and tell us promptly at the address in the Grievances section if you believe your Account has been used without your permission.
- You must not create an Account using automated means or on behalf of another person, and you must not create a new Account after we have suspended or deactivated one of yours.
- A signed-in session ends after a period of inactivity and after a maximum period, after which you will need to sign in again.
- You may stop using your Account at any time, and you may deactivate it yourself from your
Account page. Before deactivating, please note that:
- you will be signed out and will not be able to sign in to the Account again
- you will lose access to all Member Content
- password reset links for the Account will stop working and new ones cannot be requested
- the Account's email address cannot be used to create a new Account, and
- deactivation does not delete your Account details, which are kept as described in the Privacy Policy and are never sold.
- A deactivated Account can be reactivated only by us, at our sole discretion, on a request sent from the Account's email address to the address in the Grievances section.
- We may suspend, deactivate or refuse to create or reactivate any Account, at our sole discretion, with or without notice and without giving reasons, including where we believe it has been used in breach of these Terms of Use, as described in the Suspension of Access section. We shall have no liability to you for doing so.
- We handle the information in your Account as described in our Privacy Policy.
6. Permitted Use and Licence
- We grant you a revocable, limited, non-exclusive, non-transferable licence to access and view the Website and the Study Material for your own personal, non-commercial study. For Member Content, this licence is granted only while you are signed in to your own Account.
- You may not cut, copy, decompile, distribute, modify, recreate, reverse engineer, disseminate, post, publish, create derivative works from, transfer or sell any information, material or software obtained from the Website, except with our prior written permission. Limited use beyond personal study may be allowed at our sole discretion.
- For the removal of doubt, it is clarified that bulk or wholesale reproduction or copying of the content, whether for commercial or non-commercial purposes, and unwarranted modification of the data and information within the content of the Website, is not permitted.
7. Prohibited Conduct
You agree that you shall not use the Website to host, display, upload, modify, publish, transmit, update, distribute, share or store material that is:
- in violation of any applicable law or regulation
- in a manner that will infringe the copyright, trademark, trade secret or other intellectual property or proprietary rights of others, or violate the privacy, publicity or other personal rights of others
- belonging to another person and to which you do not have any right
- grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, threatening, abusive or hateful, or racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever
- harmful to minors in any way
- impersonating another person or entity
- containing software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of our systems or the systems of our users, or
- threatening the unity, integrity, defence, security or sovereignty of India or of any other country, friendly relations with foreign states, or public order, or which causes incitement to the commission of any cognisable offence or prevents the investigation of any offence, or insults any other nation.
In addition, you shall not:
- use offline browsers, site copiers, crawlers, scrapers, automated scripts or any other tool to mirror, download or systematically retrieve any part of the Website
- issue requests at a volume or rate that places an unreasonable load on our infrastructure
- circumvent, disable or interfere with any security, rate-limiting or access-control feature of the Website
- republish the Study Material, in whole or in substantial part, on any other website, application, social network, messaging group or print medium
- make Member Content available to people who are not signed in to their own Account, whether by copying, screenshots, sharing your Account or any other means
- create Accounts using false details or automated means, or hold more than one Account in order to evade a suspension, or
- attempt to gain unauthorised access to the administration area, to any Account other than your own, or to any server, database or network connected to the Website.
8. Disclaimer as regards Study Material
- We do not make any representation, guarantee or commitment to you that the Study Material is or will be free from error, omission or ambiguity.
- The number of questions, the topics covered and the material itself will be updated, including by addition and by removal, without prior notice to you and at our sole discretion.
- We do not claim or guarantee any rank, mark, examination result, admission or any other academic or professional advantage from use of the Website.
- Questions on the Website may be adapted from, or reference, publicly available examination papers. Where a question is attributed to a particular examination or year, that attribution is provided for study convenience only and is not endorsed by, and does not imply any association with, the examining authority concerned.
- Mathematical and chemical notation on the Website is rendered by third-party software in your browser. We do not warrant that it will render correctly on every Device or browser.
- You should verify anything you intend to rely on against your official syllabus, prescribed textbooks and examining authority.
9. Advertising and Third-Party Content
- The Website displays advertisements served by third parties, including Google. We do not control which advertisements are shown to you, and the appearance of an advertisement is not an endorsement, warranty or recommendation by us of the advertiser, its products or its services.
- The Website may contain links to other websites owned by third parties. We are not responsible for examining or evaluating them, and we do not warrant their products, offerings or the accuracy of their content. Before you access any third-party website you should review its terms of use and policies. If you decide to access any such website, you do so at your own risk.
- Any transaction you enter into with a third party reached through an advertisement or link is solely between you and that third party. You shall not implicate us in any claim or suit involving you and such third parties.
- The handling of your data by advertising partners is governed by their own privacy policies. See our Privacy Policy for the choices available to you.
10. Intellectual Property Rights
- All content on the Website, including designs, text, graphics, images, information, logos, button icons, software, the Study Material and the arrangement of it, is the exclusive property of B Catalysts or of our licensors, and is protected by copyright, trademark and other intellectual property laws.
- The name Intuitive Science & Math, the name B Catalysts and our logos are proprietary to us. The unauthorised copying, modification, use or publication of these marks is strictly prohibited.
- Material on the Website is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means, whether directly or indirectly, and you must not assist any other person to do so.
- Without our prior written consent, which is at our sole discretion, modification of the content, use of the content on any other website, application or networked computer environment, or use of the material for any purpose other than personal, non-commercial use is a violation of our copyrights, trademarks and other proprietary rights, and is prohibited.
- At all times we and/or our licensors remain the owner of the intellectual property in the Study Material. No part of it may be reproduced, stored in a retrieval system or transmitted in any form or by any means without our prior written permission.
11. Disclaimer of Warranties and Liabilities
- The Website and all content on it are provided on an "as is" and "as available" basis, without any representation or warranty, express or implied, except as otherwise specified in writing. Without prejudice to the foregoing, we do not warrant that the Website will be constantly available, or that the information made available through it is complete, true or accurate.
- We shall not be liable for any interference, virus, hacking or similar consequence caused by any network or internet service provider, or by your Device.
- We are not responsible for any data you lose in the course of accessing the Website. It is your responsibility to save and back up your own work.
- Any content posted by us or by an authorised third party on a third-party platform shall be subject to the terms, conditions and policies of that platform in addition to these Terms of Use.
- SUBJECT TO APPLICABLE LAWS, IN NO EVENT WILL B CATALYSTS, ITS PARTNERS, EMPLOYEES, AGENTS OR CONTRACTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE. AS THE WEBSITE IS PROVIDED TO YOU FREE OF CHARGE AND NO PAYMENT IS RECEIVED FROM YOU, OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CAUSES OF ACTION SHALL BE NIL, TO THE MAXIMUM EXTENT PERMITTED BY LAW. IF, NOTWITHSTANDING THE FOREGOING, ANY LIABILITY IS FOUND TO EXIST, OUR AGGREGATE LIABILITY SHALL NOT EXCEED INR 100 (ONE HUNDRED RUPEES) OR THE AMOUNT, IF ANY, PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS LOWER.
- Any claim or cause of action arising out of or related to the Website or these Terms of Use must be brought within one (1) year after it arises, failing which it shall be permanently barred, to the extent permitted by law.
12. Data Protection
- We will process any information that we receive from you or otherwise hold about you in accordance with these Terms of Use and our Privacy Policy. You consent to our use of such information in accordance with those documents.
- If you create an Account, we process your name, email address and sign-in details to operate it, including to send you password reset emails you ask for, as described in the Privacy Policy.
- The Website uses Cookies that are necessary for it to work, such as those that keep you signed in, protect forms and remember your consent choice. Your use of the Website is conditional on these. Any storage that is not necessary, currently only the remembering of your last visited page, is used only if you accept it in the consent banner. You may refuse it, or later withdraw your consent on the Cookie Settings page, without losing access to any other part of the Website. Where you are signed in, your choice is recorded on your Account with the date and time, as described in the Privacy Policy.
- Searches and pasted images are not stored. We do not collect, keep or process any image you paste for an image search: it never leaves your Device. The text you enter for a search, or that is read from an image, is processed only to produce the results and is not stored, logged, linked to you or used for anything else.
- We record request information, including IP address and user agent, in order to identify and block automated scraping and abusive request volumes. You acknowledge and consent to this processing as a condition of accessing the Website.
- We do not sell your personal information. We never sell, rent, lease or trade your name, email address, Account details or any other personal information to any third party, including advertisers and data brokers, for money or for any other benefit. This applies whether or not you have an Account, and continues after an Account is deactivated.
- We may share non-personal, aggregated information that does not identify you with third parties, for example to understand which topics are most used. Such information is not sold.
13. Suspension of Access
We operate automated protections against copying and abuse. Access from your Device, browser or network may be blocked, and your Account may be suspended or deactivated, immediately and without prior notice or warning, where we detect (this list being illustrative and not exhaustive):
- use of offline browsers, site copiers, mirroring tools, crawlers, scrapers or automated clients
- request volumes or patterns consistent with automated retrieval rather than reading
- systematic downloading or extraction of questions, solutions or images
- republication of our content, including screenshots and generated documents, on social media or any other network
- any attempt to access the administration area or any other restricted part of the Website
- sharing of an Account or its password, or distribution of Member Content to people who are not signed in to their own Account, or
- any other conduct prohibited under these Terms of Use.
If a violation is identified, it amounts to a substantial breach of these Terms of Use and we shall have all rights to take such action as is available under the law, including but not limited to permanently blocking access and deactivating your Account without prior notice to you.
14. Availability and Changes to the Service
- We reserve the right at any time to modify, edit, delete, suspend or discontinue, temporarily or permanently, the Website or any portion of it, including Accounts and the Member Content available to them, with or without notice. You agree that we will not be liable to you or to any third party for any such modification, editing, deletion, suspension or discontinuance.
- We will not be held responsible for any delay or failure to comply with our obligations under these Terms of Use where the delay or failure arises from causes beyond our reasonable control, including but not limited to acts of God, flood, fire, earthquake, epidemic, war, terrorism, civil unrest, strikes, government action, failure of power, internet or telecommunication networks, failure of hosting, email or other Service Providers, and cyber-attacks.
- These Terms of Use remain in full force and effect for so long as you use the Website. Your access may be terminated immediately, with or without notice and without liability to you, if we believe that you have breached any covenant, condition, restriction or limitation contained in these Terms of Use or in the Privacy Policy, or that you have interfered with the use of the Website by others.
- All provisions of these Terms of Use which by their nature should survive termination shall survive the termination of your access or the deactivation of your Account, including the provisions on intellectual property, disclaimers, limitation of liability, indemnity, and governing law and dispute resolution.
15. Indemnity
You agree to defend, indemnify and hold harmless B Catalysts, its affiliates, subcontractors, officers, partners, employees, consultants, representatives and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses (including but not limited to legal fees and costs) arising from:
- your use of and access to the Website
- claims by third parties who rely on representations made by you based on information obtained from the Website
- your violation of any condition in these Terms of Use or in the Privacy Policy, or
- your violation of any third-party right, including without limitation any copyright, property or privacy right.
16. Exclusions and Limitations
The Website is intended to be used within the jurisdiction of India. Those who access or use the Website from other jurisdictions do so at their own volition and are responsible for compliance with their local laws.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, in certain jurisdictions some of the above limitations of liability may not apply to you. Nevertheless, all other provisions of these Terms of Use remain in full force and effect.
If you are a resident of the European Economic Area (EEA), you have the right to complain to a Data Protection Authority about our collection and use of your personal information. For more information, please contact your local data protection authority in the EEA.
17. Additional Terms
- These Terms of Use, together with the Privacy Policy and any other legal notice published by us on the Website, constitute the entire agreement between you and us concerning the Website, superseding any prior agreement between you and us with respect to the subject matter covered here.
- These Terms of Use, and any rights and licences granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction.
- Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of that right or provision.
- Each provision of these Terms of Use shall be construed separately as between you and us. If any part is held to be unreasonable, inapplicable or unenforceable, but would be valid if some part of it were deleted, that provision shall apply with such modification as may be necessary to make it valid and effective, and the remaining provisions shall remain in full force and effect.
- You consent to receive communications from us electronically, including by email and by notices posted on the Website, and agree that all such communications satisfy any legal requirement that a communication be in writing.
- We may, but are not obliged to, monitor use of the Website, and we may cooperate with law enforcement authorities and courts, including by disclosing information about you, where we believe in good faith that it is required by law or necessary to protect our rights or the safety of others.
- In the event of any conflict between these Terms of Use and any other document published on the Website, these Terms of Use shall prevail, except where that document expressly states otherwise.
18. Feedback and Submissions
- Any feedback, suggestion, correction, question, solution, idea or other material that you send to us, whether by email, through a grievance or otherwise (Submission), is provided voluntarily and without any obligation of confidentiality.
- You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, distribute and otherwise exploit any Submission, in any form and medium, for any purpose, without acknowledgement of or compensation to you.
- You confirm that you have the right to make each Submission, and that it does not infringe the rights of any third party. We are under no obligation to use, respond to or act on any Submission.
19. Governing Law and Dispute Resolution
- These Terms of Use, the Privacy Policy and any dispute or claim arising out of or in connection with them or the Website (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.
- Before starting any proceedings, you agree first to raise the dispute with us in writing at the address in the Grievances section and to allow us at least thirty (30) days to try to resolve it.
- Any dispute that is not so resolved shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement of the parties or, failing such agreement, in accordance with that Act. The seat and venue of arbitration shall be Rajamahendravaram, Andhra Pradesh. The arbitration shall be conducted in English, and the award shall be final and binding on the parties.
- Subject to the arbitration clause above, the courts at Rajamahendravaram, Andhra Pradesh shall have exclusive jurisdiction over all matters arising out of or in connection with these Terms of Use and the Website, including applications for interim relief and for the enforcement of an arbitral award. You irrevocably submit to the jurisdiction of those courts.
- To the extent permitted by law, any dispute shall be resolved on an individual basis, and you shall not bring or take part in any claim as a representative or member of a class.
- Nothing in this section prevents us from seeking injunctive or other urgent relief from any court of competent jurisdiction to protect our intellectual property or the security of the Website.
Grievances
We take concerns about the Website seriously. This section explains which grievances we entertain, how to submit one, and how copyright violations and plagiarism are handled.
Categories of grievances we entertain
- Errors in Study Material: an incorrect question, answer option, answer key, hint, solution, figure or exam or year attribution.
- Account and access: problems with creating an Account, signing in, resetting a password or reading Member Content, and requests to reactivate a deactivated Account.
- Privacy and personal data: requests to see or correct the personal information we hold about you, and concerns about how it is collected, used, stored or shared.
- Blocking and suspension: requests to review a block on your Device, browser or network, or the suspension or deactivation of your Account, that you believe was made in error.
- Advertising: advertisements shown on the Website that you believe are misleading, offensive or inappropriate for students.
- Technical and accessibility issues: pages, mathematical notation or images that do not display or work correctly on your Device or browser.
- Security: reports of a vulnerability in, or misuse of, the Website.
- Copyright violations and plagiarism: claims that material on the Website infringes your copyright or has been copied from your work, handled as set out below.
We do not entertain requests for personal tutoring, requests to solve questions that are not on the Website, grievances about examination results or examining authorities, or messages that are anonymous, abusive or threatening.
How to submit a grievance
Write to us at contact@ecatalysts.in with the subject line "Grievance: " followed by its category, and include:
- your name and a working email address
- the address (URL) of each page concerned, where applicable
- a clear description of the grievance, and
- for Account matters, the email address registered on the Account.
We will look into each complete grievance and may reply to the email address it was sent from. The outcome of any grievance, and any action taken on it, is at our sole discretion. Grievances that lack the information needed to identify the issue, or that are frivolous, repetitive or made in bad faith, may be closed without further action.
Reporting copyright violations and plagiarism
If you are a copyright owner, or are authorised to act on behalf of one, and believe in good faith that material on the Website infringes your copyright or has been plagiarised from your work, you may report it to us. Only reports supported by admissible proof will be entertained. A report must contain all of the following:
- an electronic or physical signature of the copyright owner, or of the person authorised to act on the owner's behalf
- your name, address, telephone number and email address
- a description of the copyrighted work that you claim has been infringed or plagiarised
- the address (URL) of each page on the Website where the material appears, with enough detail that we can find it
- admissible proof of your ownership of, or authority over, the original work that establishes that it existed before the material appeared on the Website, such as a copyright registration certificate, a copy or scan of the published work showing its publication details (for example its ISBN or date of publication), dated original files, or a publicly archived copy of the original web page
- where you act on behalf of the owner, proof of your authority to do so
- a side-by-side comparison identifying the specific portions of the Website that you claim were copied, and the corresponding portions of your original work
- a statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent or the law, and
- a statement, made under penalty of perjury, that the information in your report is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.
Reports that do not include admissible proof, that rely on general similarity of subject matter alone, or that concern material in the public domain (such as publicly available examination questions, standard formulae or widely known methods of solution) will not be entertained.
Timelines. For a report that meets the requirements above, we will, on a best effort basis, endeavour to address it within 7 business days of receiving it. In any case, the turnaround time for resolving such a report is 45 business days from the date we receive the complete report. For this purpose, business days exclude Saturdays, Sundays and public holidays in India. Where we find, at our sole discretion, that a report is valid, we will remove or modify the material concerned, or credit the original work, as we consider appropriate. Taking any such action is not an admission of liability. A person who knowingly makes a false or misleading report is liable for all costs, damages and expenses, including legal fees, that we incur as a result.
